Hepatitis drug would cost Missouri $1 billion, says Express Scripts

A new hepatitis C drug could cripple state budgets, costing the country $55 billion to treat 750,000 people with government insurance, according to an analysis by Express Scripts.
Missouri would need to pay out $1 billion and Illinois $2.3 billion to treat all of the states' residents with hepatitis C who are either in prison or receive Medicaid benefits.
The drug, Sovaldi, costs $1,000 per pill or $84,000 for a 12-week regimen.

The pharmaceutical industry's battle for dominance in the fast-growing and lucrative market for treatments of hepatitis C is prompting an unprecedented legal scramble. The prospect that hepatitis-C drug sales could soar to $20 billion annually by the end of the decade is spurring attempts by drug companies to assert the patent rights they'll need to grab a piece of the pie (Loftus, 7/20).

over the costly new drug treatment for hepatitis C is focused on the $1,000 a pill price tag, but the real issue is the total impact on the health care system and how to systematically deal with it, CVS officials write in a commentary published Sunday. Gilead’s Sovaldi “is not really a per-unit cost outlier, but is a ‘total cost’ outlier because of its high cost combined with a very large population eligible for treatment — and a beacon for costs of specialty medications generally,” CVS Chief Medical Officer Troyen Brennan and Chief Scientific Officer William Shrank argue in the Journal of the American Medical Association. The total cost of treatment — about $84,000 just for the course of Sovaldi — is high. When multiplied by the estimated 3 million Americans who have the disease, the potential magnitude comes into focus: $250 billion (Norman, 7/20).

"  With broader screening, the pool of eligible patients may be as high as 3 million in the United States alone.7 The simple math is that treatment of patients with HCV could add $200 to $300 per year to every insured American’s health insurance premium for each of the next 5 years. Hepatitis C Spurs Unusual Patent Wars Among Big Drug Makers

... but there is another intriguing aspect to this classic pharmaceutical horse race – a series of lawsuits filed over patents. Specifically, Gilead Sciences, which was first out of the gate with the expensive and successful Sovaldi treatment, is fighting no fewer than three other drug makers in court – Merck, AbbVie and Roche – over valuable patent rights.

AbbVie has taken a particularly aggressive stance by obtaining U.S. patents covering combinations of dozens of drugs to treat the disease, including those developed by Gilead, because it is developing its own combination treatment. And so, AbbVie wants monetary damages if Gilead begins selling a combination treatment.

As for Merck, Gilead filed a preemptive lawsuit after receiving a phone call from a Merck executive who proposed licensing two Merck patents to Gilead in exchange for a 10% royalty on sales of all medicines including Sovaldi. Gilead called this a “prohibitive demand.” Merck later responded in court by claiming that Sovaldi infringes on its patents that cover compounds related to the active ingredient in Sovaldi.

Roche, meanwhile, claims it has rights to Sovaldi thanks to a decade-old research collaboration with Pharmasset, which developed the drug and was purchased by Gilead two years ago for more than $11 billion. Roche wants an exclusive license and claims Gilead infringed on its rights.

India lays down the law on drugmakers
Just last week India announced in a surprise decision from the National Pharmaceutical Pricing Authority, or NPPA, that it would be capping the price of 108 different drugs ranging from diabetes treatments to HIV therapies in order to make access to these drugs more affordable for Indian citizens. This decision follows a move last year in which India initiated price controls on more than 30% of existing medicines within the country, once again in an effort to ensure that its citizens have access to these much needed drugs.

Think about what a price cap would mean in the United States. Right now there's a huge debate over the price being charged for Gilead Sciences (NASDAQ: GILD  ) revolutionary oral hepatitis C treatment, Sovaldi, which runs roughly $1,000 per day. A standard 12-week treatment is therefore going to cost the patient and insurance company a whopping $84,000.


On one hand Gilead could be viewed as justified in its superior pricing given that Sovaldi can be offered to select genotypes without the need for interferon, thus dramatically reducing the side effects associated with treatment. More importantly, Sovaldi's success rate of eliminating detectable levels of the disease after 12-weeks ranged 90% and higher in its multiple clinical studies. Yet, this is a price that's far too high for most uninsured Americans to pay and is even causing insurers to grimace in pain. Gilead has also taken substantial heat from Congress over the pricing of its drug, to the point where it's even possible that insurers could begin denying coverage to members simply because of Sovaldi's high cost. If price caps were in place within the U.S. this wouldn't even be a discussion.






The French Government Must Issue a Compulsory License for Sofosbuvir & Seek the Usage of Generics to Treat Hepatitis C

act up basel[ACT-UP Basel Press Release, Link] Act Up-Basel called the French government to learn from the current situation regarding access to new direct-acting antivirals (DAAs) molecules used in the treatment of hepatitis C (HCV), to exercise Article L613 -16 of the Code of Industrial Property on the transmission and loss of patent holder rights to issue a compulsory license [i] and make available generic versions of sofosbuvir.

Since Sofosbuvir was licensed for sell on the European market, hepatitis experts and organizations working on HCV in France are quite certain : According to their computation, access to HCV new treatments in France will only be possible through an out-of-reach spending from the national health insurance. To treat 55% of people infected with chronic HCV in France (133,000 patients, with an advanced stage of infection – stage 2-4 fibrosis or “F2″ to “F4″), the national health insurance must pay the equivalent of the annual budget of all Parisian hospitals and health centres (Assistance Public – Hôpitaux de Paris – AP-HP) for the purchase of sofosbuvir (SOF) alone [ii] or € 7 billion. To cover the cost of the triple therapy with peg-interferon (PEG-IFN) and ribavirin (RBV) for genotype 1 (Western Europe’s most common genotype) and then, in the near future, another DAA, the price of a two-or triple therapy will be even higher. With a new DAA such as datasclavir (BMS-052), it would cost between €100,000 and 150,000 per person for a 12 week treatment, while the production cost of sofosbuvir and datasclavir combined is estimated between €57 and €122. The profit reached by Gilead Sciences, the pharmaceutical corporation marketing Sovaldi (followed by Bristol Myers Squibb for datasclavir very soon) is huge. It exceeds the margins of all other industries by far, including luxury industry. For example, Sovaldi currently marketed in the United States has already helped Gilead to rake approximately $2.3 billion in a quarter [iii].

A pill that costs €2.5 to produce, sold €650: the pharmaceutical industry is the most “profitable” for all industries.

Over the last 3 years Gilead has spent 5 billion on research, that is for all drugs, not just sovaldi. to treat 3 million people at 84K would bring in 250 billion. That is ridiculously extortionate pricing. A reasonable profit is one thing, but that is criminal, clearly the pricing only makes sense if you don't expect to treat many people.

His junior partner George Herbert Walker, and Walker's son-in-law Prescott Bush set up the money conduit from Wall Street to Fritz Thyssen's European banks to fund the rise of Hitler. Walker and Bush were on the Board of directors of the Hamburg-America Shipping Lines ship that was turned back to Nazi Europe to return Jewish refugees called "Voyage of the Damned". 

GILEAD was co-founded by Poison Gas suppliers to Saddam Hussein, Rumsfeld and Schultz, and GILEAD stole $2,000,000,000 from US taxpayers on the worthless TAMIFLU drug they sold using political connections in the Bush govt. TAMIFLU has never (NEVER) been demonstrated to protect against Bird-Flu-type-flu for which it was sold. Even regular flu it doesn't prevent but may shorten by only 1 day, if your skin doesn't all fall off and you die from the drug. 

One of Gilead directors is former manager of Audits department for Arthur Andersen, the people who cooked Enron's books and destroyed $400,000,000,000 of investors value. 

Another one of the directors was on Bush's Council of Economic Advisors who helped engineer the crash of the Bush economy in 2008 which nearly wrecked America. Cogan, he still hangs out with Schultz and co-authors advice papers over at Hoover Institution for Pampering War Criminals, and sometimes they lunch there with Condi Rice to discuss the good old days when torture was not an international war crime, but a respectable way of business.

As Thomas indicated that pricing is extortionary. Do we really believe that if they did not get these prices they would stop R&D? If they did that then no new drugs would be developed to create new revenue streams and as drugs came off of patent protection their revenues and therefore profits would drop precipitously. No this should be about drug companies keeping in mind their social responsibility while setting a price that is a fair return for the risks taken .

A transplant costs $10,000 per year for life for the anti-rejection drugs that have to be taken every day until you die. A person living with a transplant for 20 years costs $200,000, which is paid for by public disability funds since the sick person can no longer work.

Only the German National Socialists were willing to kill their poor to save medical costs, until the Republicans came along, and now them too.
